Terms of Use

These terms are a legal agreement between you and Riverside EpiCenter, LLC ("Riverside EpiCenter," "EpiCenter," "we," "us," or "our"). They govern your use of our websites, your purchases from us, and your visit to our facility at 135 Riverside Pkwy SW, Mableton, Georgia.

By using our websites, buying from us, or entering our facility, you agree to these terms. If you do not agree, please do not use our sites or services.

Scope. These terms cover website use, online purchases, and general facility admission. They do not replace the separate agreements that govern specific relationships with us: the EpiFIT Club membership agreement, event and venue rental contracts and our Venue Policies and Procedures, production location agreements, CoWork agreements, activity waivers, and official rules for any contest or giveaway. Where one of those documents applies and conflicts with these terms, that document controls for that relationship.

1. Who can use our sites and services

You may use our websites if you are 13 or older. You must be 18 or older to make a purchase, create an account, book an event, buy a membership, or register for a program. If a participant is under 18, a parent or legal guardian must complete the transaction and accept these terms on that participant's behalf.

Our text message program is limited to individuals 18 and older.

2. Accounts

Some features require an account, including membership portals, class booking, program registration, and event management tools. You agree to provide accurate information, keep your login credentials confidential, and tell us promptly if you believe your account has been accessed without permission. You are responsible for activity that occurs under your account.

We may suspend or close an account that violates these terms, is used fraudulently, or is used in a way that risks the safety of our guests or staff.

3. Purchases, tickets, and memberships

Pricing and availability. Prices, schedules, programs, and availability may change. We work to keep our sites accurate, and we may correct errors in pricing or descriptions, including after an order is placed. If we cancel an order because of a pricing error, we will refund you in full.

Tickets and event registrations. Tickets and registrations are sold through our ticketing partners, and those partners' terms and fees also apply. All ticket and registration sales are final. Tickets are non-refundable and non-transferable except where required by law or as described below.

Event cancellations by us. If we cancel an event, you will be offered a refund of the ticket price or a credit. Service and processing fees charged by a ticketing platform may not be refundable. If an event is rescheduled, tickets will be honored for the new date.

Memberships. EpiFIT Club and CoWork memberships are governed by the membership agreement you sign, which sets out dues, billing dates, term, freeze options, cancellation notice, and any initiation fee. Georgia law provides certain rights regarding health club and physical fitness service contracts, and nothing in these terms limits those rights.

Event and venue bookings. Venue bookings are confirmed only by a signed contract and the required deposit. Deposits, payment schedules, cancellation and date change fees, insurance requirements, catering exclusivity, security staffing, and load-in and load-out rules are set out in your contract and in our Venue Policies and Procedures, which are incorporated into every rental agreement. Submitting an inquiry or request form does not reserve a date.

Taxes and fees. Applicable sales tax, administrative service fees, and other fees disclosed at the time of purchase or in your contract will be added to your total.

4. Facility admission and conduct

Admission to our facility is a revocable license, not a right. To keep the building safe and enjoyable for everyone, all guests agree to the following.

• Follow posted rules, signage, and staff instructions, including the specific rules for bowling, the arcade, the rock wall, the basketball court, the track, and the fitness floor.
• Wear appropriate attire and footwear for the activity and area.
• Treat our staff, contractors, and other guests with respect. Harassment, threats, intoxication, or disruptive behavior are grounds for removal.
• Do not bring weapons, illegal substances, or outside alcohol. We do not sell alcohol. Alcohol is permitted only at private contracted events under the terms of that contract, and only for guests 21 and older with valid identification.
• Tobacco and vaping products are not permitted anywhere inside the facility. Smoking is limited to the designated exterior areas.
• Only service animals are permitted unless we have approved otherwise in advance.
• Guests 17 and under must be accompanied and supervised by an adult, except where a specific membership tier, program, league, or class expressly allows independent participation.
• Bags, purses, packages, and vehicles entering the property may be subject to inspection.

We may refuse entry, remove any person, or suspend access for conduct that violates these terms, threatens safety, or damages property. No refund is owed for admission or activity fees when access is revoked for cause.

Kidz Klub. Kidz Klub is a supervised play program for members. It is not a licensed childcare or drop-off service. A parent or legal guardian must remain on the premises for the entire time a child is in Kidz Klub, and must complete the required registration and check-in.

Activity risk. Fitness, sports, bowling, climbing, and similar activities carry inherent risk of injury. You participate voluntarily and assume those risks. Some activities and programs require a signed waiver before participation.

Lost property. We are not responsible for lost, stolen, or damaged personal property, including items left in lockers or vehicles.

Wi-Fi. We offer complimentary guest Wi-Fi as a convenience, with no guarantee of availability, speed, or security. Do not use it for unlawful activity, to infringe anyone's rights, or to interfere with our network. We may monitor, filter, or suspend access.

5. Photography and recording

We photograph and record at our facility and events. By entering, you consent to being recorded and grant us the right to use your likeness and voice in our marketing, promotional, editorial, and archival materials, as described in our Privacy Policy.

Guests may take personal photos and video for non-commercial use. Commercial photography, professional video, drones, tripods, and press or production filming require advance written approval and, where applicable, a location agreement and proof of insurance. Recording in locker rooms, restrooms, saunas, steam rooms, and other private areas is strictly prohibited.

6. Our intellectual property

Our websites and their content, including text, graphics, logos, photos, video, page layouts, and code, are owned by us or our licensors and protected by copyright and trademark law.

Riverside EpiCenter, EpiCenter, Make Every Day Epic, EPIC, EpiFIT Club, EpiCafe: Kitchen & Coffee, EpiFuel Bar, EpiSports, CoWork, REC Live, and EPIC Farmers Market are trademarks of Riverside EpiCenter, LLC.

You may view and print our content for your own personal, non-commercial use. You may not copy, reproduce, republish, sell, distribute, modify, or create derivative works from our content, or use our marks, without our prior written permission. Framing, scraping, and automated data collection from our sites are not permitted.

7. Content you submit

When you send us reviews, photos, video, testimonials, ideas, or comments, or when you tag us or use our hashtags on social media, you grant us a non-exclusive, royalty-free, worldwide, perpetual, transferable license to use, reproduce, adapt, publish, and display that content in our marketing and communications, with credit where practical. You represent that you own or have permission to share the content, that it does not infringe anyone's rights, and that anyone identifiable in it has consented.

Do not submit content that is unlawful, harassing, hateful, obscene, defamatory, misleading, or infringing. We may remove content at our discretion, and we have no obligation to monitor or publish anything you submit.

8. Promotions, contests, and giveaways

Contests, sweepstakes, giveaways, and promotions are governed by their own official rules, which are posted or linked at the point of entry and control if they conflict with these terms. Promotions run on Instagram, Facebook, or other platforms are not sponsored, endorsed, or administered by those platforms.

9. Email and text messages

Our email and text message programs, including how you opt in, what you receive, and how to stop messages, are described in our Privacy Policy. Text message consent is separate from email consent and is never a condition of any purchase.

10. Third-party services and links

Our sites link to and embed third-party services, including ticketing, class booking, program registration, payment processing, maps, and social media. Those services have their own terms and privacy policies, and we are not responsible for them, for their availability, or for transactions you conduct through them.

11. Disclaimers

Our websites and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our sites will be uninterrupted, secure, or error free, that content is complete or current, or that programs, schedules, hours, classes, instructors, or amenities will be available as listed. Information on our sites, including fitness and wellness content, is general information and not medical advice. Consult a physician before beginning any exercise program.

12. Limitation of liability

To the fullest extent permitted by law, Riverside EpiCenter and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from your use of our websites or services.

To the fullest extent permitted by law, our total liability for any claim arising from your use of our websites or from a purchase made through them will not exceed the greater of the amount you paid us for the transaction giving rise to the claim or one hundred dollars.

Nothing in this section limits liability that cannot be limited under Georgia law, including liability for gross negligence or willful misconduct, or personal injury claims to the extent applicable law prohibits limitation.

13. Indemnification

You agree to defend, indemnify, and hold harmless Riverside EpiCenter and its owners, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of our websites or facility, your breach of these terms, your violation of any law, or your infringement of any third party's rights. Event clients have additional indemnification obligations under their rental contract.

14. Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to conflict of laws principles.

Before filing any claim, you agree to contact us at info@riversideepicenter.com and give us 30 days to resolve the matter informally.

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Cobb County, Georgia, and you consent to the jurisdiction of those courts.

15. Accessibility

We want our facility and websites to be usable by everyone. If you encounter a barrier on our website or need an accommodation to participate in a program or event, contact us at info@riversideepicenter.com or (678) 903-5480 and we will work with you to provide the information or service you need.

16. Copyright complaints

If you believe content on our site infringes your copyright, send a notice to info@riversideepicenter.com with the following: your contact information, identification of the work, identification of the material on our site, a statement of good faith belief that the use is unauthorized, a statement that the information is accurate, and your signature.

17. General

Changes. We may update these terms. The "Last updated" date shows the most recent version, and changes take effect when posted. Your continued use after that constitutes acceptance. For material changes, we will provide additional notice where appropriate.

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These terms, together with our Privacy Policy, Cookie Policy, and any signed agreement between us, form the entire agreement regarding your use of our websites and services.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including fire, flood, severe weather, utility failure, labor disruption, public health emergency, or government action. Event contracts contain their own force majeure terms.
